New York state Assembly Bill 10644 would prevent and reduce the use of corporal punishment and seclusion and physical restraint in schools; prohibit the use of seclusion, mechanical restraint, chemical restraint, and dangerous restraints that restrict breathing on students; provide quicker notice to parents if restraints or seclusion is used on a student; create a private right of action for violations. Additionally, staff would receive annual training that includes evidence-based positive, proactive problem-solving interventions. Increasing evidence shows that corporal punishment, restraint and seclusion are ineffective and cause significant emotional and physical harm. Restraint and seclusion do not enhance safety, are not therapeutic, and are crisis management (not crisis prevention) strategies.
